SC refuses to entertain plea seeking stay on release of movie ‘The Kerala Story’

The Supreme Court on May 2 refused to entertain a plea seeking a stay on the release of the movie The Kerala Story on grounds that its the “worst kind of hate speech” and an “audio-visual propaganda”.

A bench of Justices K.M. Joseph and B.V. Nagarathna was told by senior advocate Kapil Sibal and advocate Nizam Pasha that the trailer of the movie, which is scheduled to be released on Friday, has garnered 16 million views.

Mr. Pasha stated, “This movie is the worst form of hate speech. It is a very audio-visual propaganda”.

The Bench stated, “There are varieties of hate speeches. This film has got certification and has been cleared by the board. It’s not like a person getting on the podium and starts giving uncontrolled speech. If you want to challenge the release of the movie, you should challenge the certification and through appropriate forum”.

Mr. Sibal then stated that he’ll do no matter needed.

Justice Nagarathna stated the petitioner ought to first strategy the excessive court docket. Mr. Pasha stated there was no time left because the movie is scheduled to release on Friday.

“This is not a ground. Otherwise everyone will start coming to the Supreme Court”, the Bench stated.

Mr. Pasha stated that’s the reason he has filed an intervention utility within the hate speech matter.

Justice Joseph stated although he is probably not advising the petitioner however for seeking applicable treatment a considerable writ petition wants to be filed.
