Supreme Court sets aside order directing Yash Raj Films to pay compensation for excluding song from ‘Fan’ movie

The Supreme Court on April 22 allowed an enchantment filed by Yash Raj Films in opposition to an order of the National Consumer Dispute Redressal Commission (NCDRC) which directed the manufacturing agency to pay ₹10,000 together with litigation prices as compensation to a client being aggrieved by exclusion of a song in Bollywood movie “Fan”.

A Bench of Justices P.S. Narasimha and Aravind Kumar set aside the NCDRC order.

“We have allowed the appeal,” the Bench mentioned.

The Supreme Court’s order got here whereas listening to an enchantment filed by Yash Raj Films Pvt. Ltd. difficult an order of NCDRC, which upheld the State Commission’s 2017 course to pay compensation at ₹10,000 to the complainant Afreen Fatima Zaidi together with a litigation value of ₹5,000.

The complainant on watching the promos of the movie starring Shah Rukh Khan determined to watch it together with her relations. The promo, which Ms. Zaidi and her youngsters had seen earlier than going to the cinema corridor to watch the movie, included a song “Jabra Fan” however when she watched the movie, the song was lacking, she had alleged within the grievance.

Feeling cheated and deceived, the complainant approached the district discussion board involved by means of a client grievance in search of compensation together with a course to the petitioners to air the promos and song with a caveat that the mentioned song was not included within the movie.

The grievance was dismissed by the district discussion board, after which she approached the State Consumer Disputes Redressal Commission, Maharashtra, which was opposed the manufacturing home.

The manufacturing home submitted that the complainant can’t be mentioned to be a client and acknowledged that the song “Jabra Fan” was proven on TV channels as a promotional trailer of the movie and it had been disclosed to the general public at giant by means of press interviews that the mentioned song won’t be part of the movie.
