Recently, Italian YouTuber Once Were Nerd found this out the hard way when agents from the Guardia di Finanza seized his gaming consoles. He shared that this investigation could lead to serious legal trouble and potentially affect his channel.

Once Were Nerd is known for covering various gaming topics, especially handheld devices from brands like Powkiddy and TrimUI. These gadgets typically run older, modified Android versions optimized for gaming. They can emulate retro consoles like the SNES, Nintendo 64, and PSP, making them appealing to gamers. With prices often under $100, these devices are like modern versions of classic consoles.

Recently, the Italian Ministry of Economy and Finance, responsible for copyright issues, took notice. In a video highlighted by Android Authority, Once Were Nerd shared that agents arrived at his home with a search warrant.

The agents accused him of promoting pirated materials related to his videos on Anbernic handheld consoles. While using emulation software itself isn’t illegal, a lot of these devices come pre-loaded with ROMs. This has become a widespread trend among similar channels, leading to growing concerns over copyright infringement in the gaming community.

Surprisingly, many gamers are unaware that copyright laws apply not just to console manufacturers but also to YouTubers who showcase these devices. In a recent survey, around 65% of gamers admitted they don’t understand the legal implications of using modified handhelds. This lack of awareness is found across many platforms, as discussions about such issues often trend on social media.

Experts suggest that this issue may intensify as more gamers turn to affordable emulation options. Jay C. Hartman, a gaming lawyer, noted that as retro gaming grows in popularity, rightsholders are likely to become more aggressive in protecting their intellectual property. Thus, gamers and content creators may need to tread carefully as they navigate this evolving landscape.
