A federal judge in New York has dismissed actor Blake Lively’s sexual harassment claims against Justin Baldoni, her co-star in “It Ends With Us.” However, two of her retaliation claims remain active.
Judge Lewis J. Liman’s ruling came after Lively filed her lawsuit last December, which included multiple allegations against Baldoni. A trial is set for May 18, as lawyers discuss jury selection.
Baldoni and his production company, Wayfarer Studios, counter-sued Lively and her husband, Ryan Reynolds, alleging defamation and extortion, but the judge dismissed those claims last June.
In his decision, Liman stated that Lively was an independent contractor. This meant she wasn’t protected by Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination based on sex.
Liman examined Lively’s claims within the context of filming. He noted that Baldoni’s actions, such as leaning in to kiss her forehead and making other intimate gestures, could imply a hostile work environment if they happened in a regular office setting. However, he argued that Baldoni was merely acting in the scene.
Liman emphasized the need for creative freedom in filmmaking, saying, “Creative artists must have some amount of space to experiment within the bounds of an agreed script.”
The movie “It Ends With Us,” based on Colleen Hoover’s 2016 bestselling novel, was released in August 2024. It combines romance with darker themes of domestic violence and became a box office success, earning over $50 million in its opening weekend. Yet, the film’s premiere was overshadowed by speculation about tensions between Lively and Baldoni.
Despite the controversies surrounding the film, both actors have notable careers. Lively gained fame from roles in “The Sisterhood of the Traveling Pants” and “Gossip Girl.” Baldoni is known for his role in “Jane the Virgin” and for directing films like “Five Feet Apart.”
The entertainment industry faces scrutiny regarding behavior on set. A recent study by the Time’s Up Foundation showed that around 47% of women in the entertainment field reported experiencing harassment at work. This raises critical questions about workplace culture in Hollywood and the importance of robust protections for actors and crew members.
As this case unfolds, it draws attention to the broader issue of harassment in the entertainment industry, highlighting the need for safe and respectful work environments.
