LOS ANGELES (AP) — Lawyers for singer D4vd are pushing for prosecutors to reveal the evidence against him in the death of Celeste Rivas Hernandez. A hearing is set for next week to make this evidence public.
D4vd, whose real name is David Burke, appeared in a Los Angeles courtroom dressed in orange jail attire. This moment marks a year since 14-year-old Rivas Hernandez was last seen alive.
During the brief court session, Burke spoke only once, responding to the judge’s procedural question. Judge Charlaine F. Olmedo scheduled a preliminary evidentiary hearing for early May, where she will decide if there’s enough evidence to move forward with a trial.
Deputy District Attorney Beth Silverman mentioned that there’s a lot of evidence to go through, including sensitive material from Burke’s phone—specifically concerning child sex abuse images. She emphasized the need to handle this information carefully. Silverman stated, “We’re eager to set this case for trial,” noting the significance of the one-year anniversary of Celeste’s death.
Burke was arrested on April 16 and has pleaded not guilty to several serious charges, including first-degree murder. His defense attorney, Blair Berk, claims the evidence will prove Burke’s innocence.
In a notable move, the defense is exercising its right to hold a preliminary hearing soon after arraignment, which is relatively rare in such cases. They want the evidence to be seen and scrutinized.

Silverman revealed that three grand juries had been convened to gather witness testimony, which raised questions about why Burke was not indicted before his arrest. Berk called the hearing “informative,” and Rivas Hernandez’s parents publicly expressed their desire for justice, remembering their daughter as a talented young girl who loved to sing and dance.
