A federal judge in Tennessee recently dropped the criminal charges against Kilmar Abrego Garcia, concluding that the investigation into his alleged human trafficking involvement was compromised. The judge argued that the probe appeared to be an attempt by the government to justify its decision to deport him to El Salvador.
Judge Waverly Crenshaw noted, “The objective evidence shows that, without Abrego’s lawsuit against his removal, the government wouldn’t have pursued this prosecution.” This comment highlights a significant concern about the motivations behind legal actions taken against individuals, especially when linked to immigration issues.
Abrego had been deported to El Salvador last year. Notably, the U.S. Supreme Court ruled that the Trump administration needed to work to bring him back. Upon his return to the U.S., he faced human smuggling charges stemming from a traffic stop in Tennessee in 2022, a claim he denied.

Sean Hecker, Abrego’s attorney, stated that his client is a victim of politically charged actions, praising the decision to dismiss the charges. In contrast, the Justice Department criticized the ruling, labeling the judge as “activist” and stating plans to appeal.
Abrego, a Salvadoran citizen who immigrated illegally as a teenager, had been living in the U.S. with his American wife and child. A court order from 2019 protects him from being sent back to El Salvador due to threats from gangs against his family.
