CHICAGO — A recent ruling from a federal appeals court has put a stop to the release of over 400 individuals detained by federal immigration agents. This pause follows a judge’s earlier order which stated that many of these detainees should be released on a $1,500 bond.
U.S. District Judge Jeffrey Cummings determined that individuals without criminal records or previous deportation orders have the right to be released. The initial decision was based on a ruling that found federal agents had breached a 2022 consent decree. This decree restricts warrantless arrests by immigration officials in specific situations.
However, the 7th U.S. Circuit Court of Appeals decided to halt the release just before it was set to happen. Arguments on this matter are scheduled for December 2. Court documents indicate that this release would have affected a total of 442 detainees held by ICE from June to early October who do not pose a threat to public safety. In total, approximately 3,300 people were arrested during that period by ICE and Border Patrol agents.
