New York Attorney General Letitia James has joined forces with 18 states and the District of Columbia to challenge a new federal policy regarding gender-affirming care for young people. This policy, announced by Health and Human Services (HHS) Secretary Robert F. Kennedy Jr., threatens to label certain gender-affirming treatments as “unsafe and ineffective.” It aims to punish health care providers by cutting off their access to Medicare and Medicaid if they continue offering these essential services.
James argues that this move is a misguided attempt by the federal government to influence medical practices. She emphasizes that decisions about health care should be made by families and doctors, not dictated by political agendas. “At the core of this declaration are real people: young people who need care, parents supporting them, and doctors following the best medical science available,” she stated.
According to a recent report from the American Medical Association, nearly 80% of healthcare providers support gender-affirming care based on extensive research showing its benefits. This type of care is recognized by major medical organizations as vital for the well-being of transgender youth.
On December 18, HHS issued a declaration that could have far-reaching implications. It would allow the agency to bar health care providers from participating in Medicare and Medicaid simply for offering gender-affirming care. Although the rules are still in proposal stage, the coalition led by James argues that such actions circumvent essential public consultation processes required by law.
The coalition warns that the effects of this policy could be severe. Transgender youth and their families may face uncertainty and fear regarding their ongoing medical care. At the same time, healthcare professionals could be forced into difficult positions, risking penalties for doing their jobs.
Casey Pick, from The Trevor Project, notes that many transgender and nonbinary youth express anxiety over anti-trans policies and the potential impacts on their health care. “All young people deserve access to the medical care they need to lead healthy, happy lives. These decisions are personal and should remain with the individual and their doctors,” she said.
Dr. Carla Smith, CEO of The Lesbian, Gay, Bisexual & Transgender Community Center, echoed similar sentiments, highlighting that such decisions should not be subjected to political maneuvering.
Public sentiment on social media shows a growing backlash against such federal policies. Posts with hashtags like #TransRightsAreHumanRights have gained traction, reflecting widespread support for transgender rights in the face of increasing legislative restrictions.
In joining this lawsuit, James and her coalition aim to preserve the rights of medical professionals and their patients. They argue that the federal government should not be in a position to dictate individual healthcare choices.
