California is taking a bold step against fast fashion with a new bill aimed at reducing its harmful impact on the environment. This legislation, called AB 405, is championed by assemblymember Dawn Addis and is currently awaiting review by a policy committee.
Known as the ‘Fashion Environmental Accountability Act,’ this bill would require fashion retailers to produce reports on their environmental practices. These reports will be monitored by the Department of Toxic Substances Control, which will oversee aspects like chemical management, greenhouse gas emissions, and wastewater testing. Retailers will need to create policies that promote responsible practices and identify risks related to social and environmental harm.
If the bill is enacted, starting July 1, 2027, retailers in California must submit an annual Environmental Due Diligence report. This report should detail their goals for reducing emissions across their operations. Beginning January 1, 2028, the requirement expands to include suppliers involved in dyeing, finishing, printing, and garment washing. These suppliers will also need to report their water usage and the levels of chemicals they use.
Businesses that fail to comply could face fines of up to 2% of their annual revenue. The collected fines will contribute to the Fashion Environmental Remediation Fund, which will support environmental projects aimed at helping communities affected by the fashion industry.
Assemblymember Addis highlighted the urgency of this action, stating, “Fast fashion has fueled a global crisis. We cannot stand by while companies profit from depleting natural resources and using toxic chemicals that harm our environment and people. The Fashion Environmental Accountability Act will hold them accountable.”
California has been proactive in promoting sustainability compared to other states. The state has introduced several bills focused on creating a more eco-conscious fashion industry, such as the Climate Corporate Data Accountability Act and the Garment Worker Protection Act. These efforts show a strong commitment to protecting the planet and promoting fair practices in the fashion sector.
