Delhi HC Dismisses Petition for Creation of Gujjar Regiment in Indian Army: What It Means for the Community

The Delhi High Court recently rejected a public interest litigation (PIL) aimed at urging the Central Government to create a regiment for the Gujjar community in the Indian Army. Chief Justice DK Upadhyay criticized the petitioner, Rohan Basoya, for bringing forth a divisive issue.

In his argument, Basoya pointed out that the Gujjar community has a proud history of military service and has played an important role in India’s past struggles for freedom and security. He noted that the Indian Army includes various community-based regiments, like the Sikh, Jat, and Gorkha regiments, which celebrate different ethnic backgrounds.

The petition claimed that not having a Gujjar regiment would unfairly limit their representation in the armed forces. Basoya argued this exclusion could contradict Articles 14 and 16 of the Indian Constitution, which ensure equal rights and opportunities for all citizens.

Despite these claims, the court did not agree to issue a directive on the matter. The judges suggested that Basoya should conduct further research before submitting such petitions. Following this feedback, he chose to withdraw his petition.

This case raises interesting questions about representation in the military and the nuanced role of community identities in national service. Historically, the Indian Army has mirrored the country’s diverse culture, with regiments often reflecting regional identities.
