ATLANTA – During a court hearing, elections expert Ryan Macias challenged the FBI’s justification for seizing ballots from Fulton County, Georgia. He stated the evidence used by the FBI was flawed and full of inaccuracies.
Macias, who once served at the U.S. Election Assistance Commission, pointed out that the irregularities the FBI cited did not indicate a crime. He argued that the witnesses the FBI relied on seemed poorly informed and used confusing terminology. “Most of the witness statements lack a factual basis,” he said, emphasizing the disconnect between those claims and reality.
This hearing arose after the FBI conducted a raid in January to seize ballots, which led Fulton County to sue for their return last month. In court, Abbe Lowell, representing the county, criticized the government’s reliance on witnesses, including conservative activist Kurt Olsen. Olsen has been sanctioned multiple times for misleading statements about elections.
Macias’s testimony is significant as it’s the first time the FBI’s investigation into the 2020 election has been publicly scrutinized in court. Former President Trump, who has repeatedly claimed the election was stolen, supports the FBI’s actions, even as legal challenges and claims of fraud have largely been dismissed by judges.
Lowell argued that the FBI’s affidavit lacked evidence of any criminal intent, which is crucial for establishing a crime. He stressed that mere electoral irregularities do not equate to criminal activity without proof of intentional wrongdoing.
Interestingly, this case reflects a growing trend. Recent surveys show that public trust in election processes is waning. According to a 2022 poll by the Pew Research Center, only 28% of Americans are very confident that votes in elections are counted accurately. This skepticism often stems from misinformation and conspiracy theories surrounding election integrity.

Trump’s pressure on local officials to overturn election results adds another layer of complexity to this situation.
