Illinois Gov. JB Pritzker recently signed a new law that bans the use of artificial intelligence in providing mental health services. This move is all about keeping residents safe from potentially harmful advice.

The law, called the Wellness and Oversight for Psychological Resources Act, clearly states that AI cannot be used to offer therapy or make clinical decisions. However, AI tools can still help with tasks like scheduling appointments or taking notes, as long as they don’t involve direct patient care.

If someone breaks this law, they could face fines of up to $10,000, which will be enforced by the Illinois Department of Financial and Professional Regulation.

Mario Treto, Jr., the secretary of Illinois’ financial regulation, emphasized that the state wants quality healthcare delivered by trained professionals. He noted that AI systems can generate inappropriate responses, highlighting a troubling case where an AI therapist suggested drug use to a fictional character seeking help.

This legislation comes amid rising concerns over AI in sensitive areas, particularly healthcare. During a hearing last year, Illinois lawmakers and experts highlighted that AI lacks the empathy and accountability required for effective mental health treatment.

State Rep. Bob Morgan, who led the hearing, remarked that the rapid progress of AI puts additional pressure on existing healthcare systems and regulations.

Other states, like Florida, are also looking to regulate AI. Gov. Ron DeSantis mentioned that he views AI as a major issue and plans to develop guidelines for its use, reinforcing the growing awareness of AI’s impact on society.

As AI technology advances, the need for clear rules and safe practices in healthcare will only increase. Ensuring mental health services remain personal and professional should always be a priority.
