Valentino Cash Amil, charged with murder after fatally hitting 74-year-old Dannielle Spillman with his car, will stay in jail until his preliminary hearing. This decision was made by Judge Lianne Dumas in San Francisco superior court.
Amil, who pleaded not guilty, has a defense attorney, Seth Morris. He argued that Amil felt remorse and understood the gravity of the situation. Morris noted that Amil has no criminal history and strong ties to the community, suggesting he wouldn’t flee if released.
However, Judge Dumas was not swayed. She emphasized that even if Spillman seemed threatening, running her over was unjustifiable. Dumas pointed out Amil’s actions after the incident as concerning. Instead of staying at the scene or seeking help, he drove away after waiting at a gas station for a minute and a half.
City prosecutor Edward Mario highlighted the video evidence showing that Amil accelerated toward Spillman, indicating an awareness of his actions. Amil was arrested shortly after in Potrero Hill, heading away from his home.
Amil broke down in court, shouting, “I’m sorry,” while reaching out to his family. Despite their tears and claims of his innocence, Dumas remained firm in her decision to deny his release. An older woman cried outside the courtroom, insisting it was just an accident.
Amil’s preliminary hearing is set for May 6, where he may again request to be released. This case raises questions about public safety and the legal standards for determining flight risk in similar circumstances.
