PHOENIX – A lawsuit by the East Valley Institute of Technology (EVIT) regarding a long-term lease with Adelante Healthcare has been dismissed. The lawsuit was tied to a 40-year lease signed in 2011.
On February 26, EVIT filed a complaint in Maricopa Superior Court. However, the court dismissed it on Tuesday, citing that it exceeded the eight-year statute of limitations for such cases, as stated in court records.
Pedro Cons, CEO of Adelante, expressed relief at the judge’s decision. He emphasized the importance of focusing on healthcare rather than legal battles. “Adelante looks forward to putting this matter behind us,” he noted, highlighting a commitment to community health.
EVIT isn’t seeking to evict Adelante but is contemplating an appeal. Superintendent Dr. Chad Wilson stated, “We must ensure taxpayers are fairly compensated.” He expressed concern that taxpayers might be losing out under the current lease agreement.
So, how do these organizations connect? Adelante operates a 45,000-square-foot healthcare center on EVIT’s main campus in Mesa. Mesa Medical, which built the facility at no cost to EVIT, receives over $60,000 monthly from Adelante. Meanwhile, EVIT gets about $2,800 a month from the lease, which raises questions about fair market value.
EVIT’s lawsuit stemmed from concerns about the lease’s legality. School officials alleged it was not authorized correctly and violated the Arizona Constitution by benefiting a private business. Notably, the current Adelante leadership was not involved in the original lease negotiations and found no wrongdoing upon reviewing the deal. In fact, they were considering a countersuit against EVIT for $200 million in damages.
