A federal judge in Washington recently raised concerns about how the Trump administration established and managed Elon Musk’s Department of Government Efficiency. This department, also known as the U.S. DOGE Service, might not comply with the Constitution, according to Judge Colleen Kollar-Kotelly.
During a hearing, Judge Kollar-Kotelly expressed worries about the agency’s structure and the way it operates. She highlighted a key issue: the Constitution requires that leaders of federal agencies should be nominated by the president and confirmed by the Senate. Musk was neither nominated nor confirmed, which could indicate a constitutional problem.
These comments were part of a civil case filed by two labor unions and an organization representing millions of retirees. They are asking the court to prevent Musk’s team from accessing sensitive records from the Treasury Department. The outcome of this case could impact Musk’s organization and its future operations.
