Michigan Judge Drops Charges Against So-Called ‘Fake’ 2020 Electors: What You Need to Know

A judge has dropped criminal charges against 15 Republicans who tried to act as members of the electoral college in an effort to overturn the 2020 presidential election results for Donald Trump. The group believed the false claims of widespread voter fraud and sought to replace Democratic representatives in Michigan.

According to prosecutors, these individuals met secretly and signed documents stating they had been chosen to represent Michigan. However, District Court Judge Kristen D. Simmons ruled that the group legally exercised their constitutional rights, stating they were not “savvy or sophisticated enough” to fully grasp the electoral process.

Judge Simmons noted that they didn’t forge official seals or signatures. She recognized that their actions stemmed from a genuine belief in irregularities within the election. The defendants included several prominent Michigan Republican officials.

After a lengthy vote counting process in November 2020, exacerbated by pandemic-related changes, Joe Biden won Michigan with 2.8 million votes compared to Trump’s nearly 2.65 million. Biden’s victory secured him all 16 of Michigan’s electoral votes, contributing to his overall win of 306 to 232.

Following the judge’s ruling, Michigan’s Attorney General, Dana Nessel, expressed her disappointment, indicating that an appeal may be forthcoming. She described the defendants’ actions as a coordinated attempt to undermine the election results.

On the other hand, John Freeman, a lawyer for one of the defendants, praised the ruling as a reflection of the legal system functioning as it should, calling the charges a politically motivated attack.

This case isn’t isolated. Similar criminal cases are ongoing in Arizona, Georgia, Nevada, and Wisconsin. Over 160 individuals are facing charges across various states related to attempts to contest the 2020 election results.

In light of such events, experts emphasize the importance of upholding election integrity. A recent study by the Brennan Center for Justice found that public trust in elections is crucial for democracy. While some may harbor continuing doubts about past elections, the consensus among experts is that transparency and adherence to established processes are key to restoring that trust.
