Mitigating Risks: Expert Insights from WilmerHale for Your Business

By the power granted to me as President, I am issuing this order to address the serious risks posed by certain major law firms, particularly those that threaten American interests. Some firms engage in actions that jeopardize public safety, national security, and the integrity of our democracy. Often, they do this under the guise of pro bono work, using clients’ money to support causes that can harm their own clients. It is unacceptable for these firms to access our nation’s secrets and receive federal funds when their actions may contradict the values we stand for.

Wilmer Cutler Pickering Hale and Dorr LLP (WilmerHale) is one such firm that has misused its position. They are known for supporting partisan politics and contributing to racial discrimination and efforts that complicate law enforcement. For instance, they have been linked to initiatives aimed at allowing noncitizens to vote, undermining the foundation of American elections. Disturbingly, WilmerHale has also faced allegations of discrimination within its own ranks.

The actions of lawyers within this firm can undermine justice. For example, they welcomed Robert Mueller and his team after leading one of the most contentious investigations in recent American history. This investigation seemingly distorted the political landscape and affected many who aimed to serve the public effectively. Rewarding this kind of behavior from an influential law firm sends the wrong message.

To protect our national interests, the Attorney General, the Director of National Intelligence, and heads of relevant agencies must act swiftly. They should suspend any security clearances held by individuals from WilmerHale while reviewing their alignment with national interests. Additionally, the Office of Management and Budget will work to halt government services provided to WilmerHale as quickly as the law permits.

Moreover, federal contractors must disclose if they do business with WilmerHale. Agencies will review all contracts with the firm to ensure taxpayer dollars do not support behavior that is contrary to American values. Within 30 days of this order, a report will outline any actions taken regarding contracts with WilmerHale.

It’s crucial to highlight that this initiative aligns with a broader need to combat discrimination in all forms. Nothing in this order limits actions already taken against other firms if they pose similar risks.

We must limit access to federal buildings for employees of WilmerHale when their presence might threaten national security. Agencies should also exercise caution when considering hiring personnel from this firm unless it is clear that such hires do not threaten our interests.

This order is designed to protect the integrity of our government and ensure that taxpayer resources are used appropriately. It is essential to prioritize actions that are in the best interest of the American people.
