This summer, activists from the Southern Environmental Law Center (SELC) took a stand against Elon Musk’s AI company, xAI. They raised concerns about the use of unpermitted gas turbines at xAI’s data centers in Memphis, claiming these turbines could worsen air pollution in the area. Recently, the Environmental Protection Agency (EPA) aligned with these concerns, indicating that these turbines cannot operate without proper permits.
To power its services, like the Grok AI chatbot and Grok image generator, xAI initially relied on gas turbines, labeling them as “non-road engines.” The idea was that, without a permanent setup, these turbines could skirt air quality regulations. However, new EPA guidelines clarified that temporary use does not exempt companies from following clean air rules.
Earlier, xAI benefited from a local loophole that allowed turbines to operate without permits if they were in place for less than a year. As a result, they set up 35 turbines at their site. Now, the situation has shifted. While xAI has obtained local permits for some generators, the new federal rules dictate that the EPA, not local authorities, will oversee permitting.
Amanda Garcia, a senior attorney with SELC, emphasized that companies can’t build or operate these turbines without permits. She expressed hope that local health officials will act quickly to protect the community from any harmful air pollutants.
Interestingly, less than a year ago, during his time at another company, Musk sought to reduce EPA contracts to minimize government waste. At that time, the EPA’s administrator praised the company for its innovative suggestions.
