Four families in the San Diego area have taken a stand against Rady Children’s Health, filing a class-action lawsuit. They claim the hospital has violated their transgender children’s civil rights by stopping gender-affirming care.
According to the lawsuit, filed in San Diego County Superior Court, Rady’s actions harmed about 1,900 patients who now face canceled appointments, halted hormone therapy, and increased emotional distress. They believe this decision was discriminatory based on their gender identity and health needs.
Rady Children’s Health recently announced it would no longer provide gender-affirming care for minors due to new federal policies. The previous administration labeled transgender health services as “chemical and surgical mutilation” and aimed to cut funding for such programs nationwide. Federal authorities have since scrutinized clinics, including Rady.
California Attorney General Rob Bonta responded by suing Rady, claiming violations of a merger agreement that protects existing services. A judge has temporarily stopped the hospital from halting these services, but the legal battle continues.
Critics, including LGBTQ advocates, are disappointed that Bonta did not pursue broader civil rights violations against Rady. California law protects against discrimination based on sexual orientation and gender identity, defining gender-affirming care as essential.
Other hospitals in California have also reduced gender-affirming services, citing federal influence. Advocates hoped that Bonta’s legal action would encourage broader protections.
Shannon Minter, legal director for the National Center for LGBTQ Rights, represents the families. He stresses that society shouldn’t stand by while hospitals make exclusionary decisions. “That sets a dangerous precedent,” he noted.
Major medical organizations, including the American Medical Association and the American Academy of Pediatrics, affirm that gender dysphoria is a serious medical issue requiring care.
This lawsuit not only aims to assist Rady’s patients but also serves as a warning to other healthcare providers.
