Washington, D.C. — The Supreme Court is set to hear the case Monsanto Company v. Durnell, where Bayer, the pesticide giant, is trying to block lawsuits from cancer patients. Food & Water Watch and their allies filed a brief supporting the Durnell case, emphasizing the importance of allowing these patients to seek justice.
Bayer wants the court’s backing to shield itself from lawsuits claiming its Roundup product caused cancer. If successful, this ruling would leave many patients without a legal path to hold the company accountable. In the meantime, Senator Cory Booker is working on the Pesticide Injury Accountability Act, aimed at protecting the right to sue over pesticide-related harms.
Tarah Heinzen, the Legal Director at Food & Water Watch, shared her concerns about the implications of this case. She stated, “If the Supreme Court rules in favor of Bayer, it may prevent many Americans affected by pesticides from getting justice. This situation highlights the need for Congress to step up and safeguard citizens’ rights.”
Bayer has faced significant financial fallout since acquiring Monsanto in 2018, settling over 100,000 cancer lawsuits for around $11 billion. Glyphosate, the main ingredient in Roundup, has been labeled a probable carcinogen by the World Health Organization. A recent analysis by Food & Water Watch found a link between high glyphosate use and increased rates of non-Hodgkin lymphoma, especially in the Midwest, where glyphosate is extensively used on crops.
Furthermore, Bayer is also advocating for so-called Cancer Gag Act bills, intended to limit lawsuits against pesticide companies in various states. There’s a similar provision in the Farm Bill that is presently awaiting a vote in the House.
This situation raises a crucial question about the balance between corporate interests and public health. It underscores a growing movement advocating for stronger regulatory frameworks to hold corporations accountable for harmful practices. As this case unfolds, it’s clear that both environmental health and consumers’ rights hang in the balance.
