Texas Governor Abbott Takes Action: Lawsuit Filed to Challenge Alleged Violations

Texas Governor Greg Abbott has taken a striking step by filing a lawsuit to remove Rep. Gene Wu, one of the state’s House Democratic leaders. Abbott labeled Wu as “the ringleader” among many Democratic lawmakers who left Texas to block a key redistricting vote.

The governor’s emergency petition was submitted to the Texas Supreme Court. Just days prior, he had announced that if the lawmakers did not return for a House session, he would seek their removal from office. Abbott stated that their absence violates quorum requirements, which are necessary for the legislative process. He believes this refusal to attend shows neglect of their responsibilities to Texans.

In 2021, Texas Attorney General Ken Paxton issued a non-binding opinion claiming that legislators could lose their seats if they did not show up. However, political experts like Mark Jones from Rice University contend that the legislature can only expel a member through a two-thirds vote, not merely through legal action.

The recent actions stemmed from an effort by Democrats to block a Republican-backed redistricting plan. This plan aims to tilt congressional districts in favor of Republicans ahead of the upcoming 2026 midterms. When Democrats left the state, it meant that the House could not muster enough members to debate the redistricting bill, leading to calls for civil arrest.

In response to the lawsuit, Wu defended his decision to stay away from the session, claiming it was not abandonment but rather a commitment to his principles.
