President Trump recently signed an executive order aimed at cutting federal benefits for undocumented migrants. He claims that these benefits encourage illegal immigration. However, it’s important to note that, generally, the federal government does not provide benefits to those who are in the U.S. without authorization.
The order lacks specific details but instructs federal agencies to investigate any improper distribution of government funds. The Office of Management and Budget and the Department of Government Efficiency have 30 days to identify and propose solutions regarding federal funding that might go to undocumented individuals.
So, what benefits can undocumented immigrants currently receive? Not many. They can access emergency medical care and public schooling for children, but most federal benefits are off-limits. This restriction is part of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, and any changes would require Congressional approval.
The absence of federal assistance is one factor contributing to difficulties in cities trying to support the growing number of undocumented immigrants crossing the border.
Trump’s administration has not detailed its spending on undocumented immigrants. A key aim of the new order is to determine this expenditure. While Trump and his team argue that undocumented immigrants strain federal resources, there is currently no concrete assessment of these costs.
The review will seek to uncover federal benefits given to those who aren’t eligible, including temporary visitors and those lacking authorization altogether. Despite ongoing concerns from conservatives about undocumented individuals receiving federal support, claims of widespread misuse have not been substantiated.
As Heidi Altman from the National Immigration Law Center pointed out, evidence of significant benefits fraud within undocumented communities is lacking.
The practical implications of this executive order are still uncertain. It directs officials to track instances where benefits might be misallocated to undocumented immigrants. Altman noted that such orders tend to create fear among immigrant communities nationwide.
