PORTLAND, Ore. — A federal judge has mandated that U.S. immigration agents in Oregon can no longer arrest individuals without a warrant unless there’s a real chance of escape. This ruling, made by U.S. District Judge Mustafa Kasubhai, resulted from a class-action lawsuit against the Department of Homeland Security. Critics have pointed out that the department’s approach often seems to be “arrest first, justify later.”
The judge’s decision is a big deal amid ongoing concerns about civil rights. Similar rulings have come from courts in Colorado and Washington, but the government has appealed those decisions. Recently, Todd Lyons, the acting head of U.S. Immigration and Customs Enforcement, emphasized the need for a proper warrant or at least probable cause before making an arrest.
During the hearing, Victor Cruz Gamez, a 56-year-old grandfather, shared his painful experience. He came to the U.S. in 1999 and holds a valid work permit. Yet, after being pulled over by immigration agents last October, he found himself detained for three weeks, even with proof of his legal status. This ordeal affected not just him but his family, sparking fear that kept them from even opening their door for weeks.
Judge Kasubhai called the actions of immigration agents “violent and brutal,” stressing that due process is vital in a democratic society. His concerns reflect a broader pattern. According to a report from the American Civil Liberties Union, reports of unnecessary and aggressive tactics by immigration agents have increased over recent years.
Organizations like Innovation Law Lab, which is behind the lawsuit, hope this case will spark systemic change. Executive Director Stephen Manning emphasized the need for the government to adhere to the law.
As the case continues, the preliminary injunction will remain in effect, a step seen as a protective measure for many in similar situations.
