UT Students Take Legal Action Against University Following Arrests at 2024 Pro-Palestine Protest

Four students from the University of Texas are taking legal action against the university and several key figures, including Governor Greg Abbott. Their lawsuit follows their arrests during a pro-Palestine protest on campus in April 2022.

The lawsuit argues these students faced retaliation for exercising their First Amendment rights. Co-counsel Chris Godshall-Bennett highlights that the students were unfairly targeted for their political beliefs.

According to Godshall-Bennett, a chaotic scene unfolded as the protest began. Police reportedly dispersed the crowd abruptly, and students were randomly arrested. For instance, one student, Heilrayne, described being tackled by several officers, who twisted her arms and used zip ties. Similarly, Soto-Ferate recounted a rough arrest experience, while Medrano suffered nerve compression due to tight restraints. Cisco’s arrest included having her hijab removed, raising serious concerns about respect for individual rights.

All four students faced charges of criminal trespass and disciplinary actions from the university, which Godshall-Bennett argues violated their civil rights.

In recent years, protests on college campuses have increasingly stirred debate about free speech and the treatment of dissent. According to a 2022 survey by the Foundation for Individual Rights and Expression, nearly 80% of college students reported feeling uncomfortable expressing their political views. This reflects a broader trend in which young people grapple with navigating freedom of expression.

The students’ lawsuit seeks multiple outcomes: a declaration that their constitutional rights were violated, a reversal of disciplinary actions, and damages to compensate for their experiences.

Godshall-Bennett stresses the importance of standing firm on these rights, regardless of political leadership. The ongoing dialogue about academic freedom and protest rights remains crucial, especially as societal tensions around political issues like the Israeli-Palestinian conflict continue to rise.
