A nonprofit group has stepped into the spotlight by filing a misconduct complaint against Judge Sarah Merriam of the U.S. Court of Appeals for the Second Circuit. The Legal Accountability Project claims she bullies and mistreats her law clerks, leading to a culture of fear that prevents them from voicing their concerns.
Aliza Shatzman, president of the Legal Accountability Project, described Merriam’s behavior as typical bullying: yelling, berating staff, and sending frantic emails. This isn’t the first time Merriam has faced scrutiny; this is the second publicly known complaint against her in four years.
Reports suggest a troubling pattern. In late 2023, an internal investigation examined another unnamed judge from the Second Circuit for having an “overly harsh” management style. Though that judge’s identity wasn’t released, legal commentator David Lat alleged it was Merriam.
Indeed, the findings from this previous investigation echo claims made in the recent complaint. Complaints like these are usually handled by the courts themselves, which raises questions about their independence and accountability. An investigation by NPR found many judges maintain this power imbalance, leading to significant issues for the clerks who work under them.
Shatzman stated that she’s heard from clerks who have experienced troubling behavior from Merriam. Some have left their positions, including one clerk who quit after just a month due to the reported abusive environment.
Despite reaching out to court officials for comments, responses were sparse. In general, courts typically remain tight-lipped about ongoing misconduct investigations.
This situation highlights a bigger issue: the imbalance of power between federal judges and their law clerks. These young professionals often lack job protections enjoyed by workers in other fields, leaving them vulnerable to mistreatment. Past complaints about judges have sometimes led to initiatives aimed at improving workplace conditions, but the recent filing suggests there’s still much work to be done.
Legal experts emphasize the importance of addressing these power dynamics to foster a healthier work environment. According to the American Bar Association, there should be clearer guidelines that ensure all court employees can voice concerns without fear of retaliation.
As this complaint unfolds, it may prompt deeper investigations into workplace conditions and a reevaluation of how judges manage their chambers—a crucial step in ensuring respect and dignity in the judicial system.
