Democrats Take Legal Action Against Trump: Challenging His Bid to Control Independent Election Agency

The Democratic Party is taking legal action against President Donald Trump. The case focuses on an executive order he issued, which could give him more power to influence elections in favor of the GOP.

This lawsuit was filed by the Elias Law Group on behalf of three national Democratic committees. It challenges Trump’s executive order from earlier this month that grants him unprecedented control over certain regulatory agencies meant to operate independently from the White House.

The main concern is the Federal Election Commission (FEC). Formed in 1974, the FEC is designed to enforce federal campaign finance laws. It operates with a bipartisan board of six commissioners approved by the Senate. The lawsuit argues that Trump’s order could undermine this independence.

According to the plaintiffs, if the order is upheld, Trump could sway FEC decision-making to benefit his party. The lawsuit states, “Removing the FEC’s independence and replacing it with the President’s decree harms us by putting the opposing party in charge of interpreting campaign finance law.”

Filed in the District Court of D.C., the lawsuit seeks a ruling to affirm the FEC’s independent status and prevent the Trump administration from applying the order to its commissioners. It also asks the court to involve the D.C. Circuit Court of Appeals to assess the constitutionality of the Federal Election Campaign Act, which established the FEC.

This order represents a significant move towards a goal of some conservatives: to end the autonomy of regulatory agencies and centralize power in the White House. This objective aligns with a controversial legal theory suggesting the president has unlimited authority over the executive branch’s actions.

In previous rulings, like Humphrey’s Executor v. U.S., the Supreme Court has ruled against presidents dismissing members of independent regulatory bodies like the FEC. However, Trump has made moves that seem designed to challenge these principles, potentially setting the stage for cases that could reach the Supreme Court, now led by a Republican majority.

The implications of this lawsuit are significant. If the court rules in favor of the Democrats, it could protect the FEC’s independence. However, a ruling in favor of Trump could reshape the future of campaign finance laws and regulatory power in the U.S.
