It suggests that male and female athletes should be treated equally regarding these payments. However, the Trump administration has the power to change or eliminate this guidance.
Senator Ted Cruz from Texas has expressed strong opposition to this memo, noting it is not law yet. The Biden Justice Department also criticized the proposed $20.5 million cap in the House v. NCAA settlement, stating it goes against free-market principles. A federal judge has given initial approval to the settlement, but its final confirmation is scheduled for April 7.
