Karnataka High Court Denies Deportation Request for Pakistani Children Following Pahalgam Attack: What You Need to Know

Bengaluru: The Karnataka High Court has decided not to block the Central Government’s order for all Pakistani nationals in India to leave. This directive came after a recent terrorist attack on tourists in Pahalgam, Kashmir. A bench led by Justice MG Uma dismissed a plea from three Pakistani-Indian children worried about being forced to depart.

The petition was made by Bibi Yamina, 8, Muhammad Mudassir, 4, and Muhammad Yusuf, 3. Their mother is an Indian citizen, and they were seeking protection against deportation. They traveled to India on valid visas for a family wedding in January 2025 and had their visas extended to June 18, 2025.

Following the deadly attack in Kashmir, the Indian government mandated that all Pakistani nationals in India must leave by April 30, 2025. The children and their mother attempted to return to Pakistan on April 28 but were denied entry at the Attari border. Pakistani authorities said no one was there to receive them, leaving them with nowhere to go.

They returned to Mysuru and sought a long-term visa or an extension. However, no action had been taken by the time of the court hearing. Facing a warning of strict consequences for overstaying their visa, the family approached the High Court for protection until May 15, 2025.

The court, however, upheld the government’s right to enforce immigration laws for national security. This case highlights ongoing tensions regarding immigration and security in India, especially following recent violent events.

According to a recent survey by the Institute for Conflict Management, nearly 40% of Indians express heightened concern for national security in the wake of terrorist incidents. This reflects a broader sentiment that affects policies around immigration and the treatment of foreigners.

Experts suggest that while national security is crucial, more compassionate measures should be considered for families caught in these situations. Balancing security needs with humanitarian concerns remains a complex issue for the Indian government.
