President Donald Trump recently signed an executive order that halts the security clearances of staff at Perkins Coie. He took this action due to the law firm’s efforts in diversity, equity, and inclusion.

“This is an absolute honor to sign,” he stated during the announcement in the Oval Office.
Perkins Coie is a well-known law firm in Washington, particularly for its association with the Democratic Party. Marc Elias, a prominent elections lawyer, worked there for several years. He has been involved in various legal efforts for Democratic campaigns. The firm still provides legal support for the Democratic Senatorial Campaign Committee.
Trump’s dissatisfaction with Perkins Coie intensified after the 2016 election. The firm had used Democratic funds to hire a research firm that created the controversial Russia dossier about Trump and his campaign.
Lately, Perkins Coie has been vocal against the Trump administration’s actions in court. Several attorneys from the firm are challenging Trump’s ban on transgender individuals serving in the military.
A representative from Perkins Coie said, “We have reviewed the Executive Order. It is patently unlawful, and we intend to challenge it.” This shows their commitment to fighting against the order.
The executive order also instructs agency heads to limit Perkins Coie employees’ access to federal buildings if it threatens national security or doesn’t align with U.S. interests. Lawyers often need this access for meetings involving regulatory and investigative clients.
Additionally, Trump aims to prevent federal agencies from hiring members of Perkins Coie.
This isn’t the first time Trump has suspended security clearances for lawyers. He previously did so for lawyers at Covington & Burling who were involved in representing Jack Smith, the former special counsel. Trump has also revoked the clearances of prominent whistleblower attorney Mark Zaid and others.
Security clearances are crucial for lawyers representing clients in cases that require access to classified information or materials related to national security.
This decision to suspend the clearances of lawyers Trump opposes has caused concern in the legal community, especially in Washington. Being able to choose legal representation is a cornerstone of the legal profession. Interestingly, even Trump’s defense lawyers for his classified documents case received security clearances approved by the Biden administration to adequately defend him in court.
This action raises significant questions about the independence of legal representation and the implications for lawyers working in politically charged environments.
