Two federal judges recently ruled that the Trump administration cannot suspend food aid for over 40 million low-income Americans during the ongoing government shutdown. This decision came from judges in Rhode Island and Massachusetts, stating that the government must use emergency funds to maintain the Supplemental Nutrition Assistance Program (SNAP) benefits.
SNAP provides reloadable debit cards for purchasing essential food items. However, the U.S. Department of Agriculture (USDA) announced that it wouldn’t distribute food assistance in November due to the shutdown, claiming funds were depleted.
A typical family of four receives about $715 a month from SNAP, roughly $6 per person daily. While the federal government has shut down, some states are stepping in to cover the shortfall, but they won’t be reimbursed.
Half the states have challenged the suspension of funds, aiming to compel the administration to access a $6 billion emergency fund for SNAP. The Massachusetts judge emphasized that SNAP benefits should proceed at a reduced rate if necessary, citing that Congress intended for this funding to be available during funding gaps.
Judge Indira Talwani pointed out that the administration was wrong to believe it couldn’t use these contingency funds during the shutdown. Typically, SNAP costs about $8.5 to $9 billion monthly, and even if the emergency fund is tapped, it would only cover about 60% of beneficiaries for one month, according to the Center on Budget and Policy Priorities.
In a related case, Rhode Island judges heard concerns from cities and NGOs about the “unlawful suspension” of SNAP. Judge John McConnell highlighted the fear this situation has created for families dependent on this support for food.
The White House has not commented on the rulings, but Agriculture Secretary Brooke Rollins stated they were evaluating their options. Before the rulings, she was asked if they would comply with any court orders to release funds, indicating uncertainty in the administration’s response.
