A federal judge has reinstated Gwynne Wilcox, a Democratic member of the National Labor Relations Board. This decision came after a ruling that President Trump’s attempt to fire her was unlawful.
Judge Beryl A. Howell issued a strong critique of Trump’s view of executive power, emphasizing that the president cannot simply control independent agencies. She pointed out that Trump’s declaration during the 2024 campaign, where he referred to himself as a dictator from “Day 1,” highlights a misunderstanding of his constitutional role. Howell criticized an image shared by the White House showing Trump wearing a crown, stating, “A president who touts an image of himself as a ‘king’ or a ‘dictator’ fundamentally misapprehends the role under Article II of the U.S. Constitution.”
Judge Howell made it clear that while the president has certain powers, they are not absolute. “An American president is not a king — not even an ‘elected’ one,” she stated, reinforcing the idea that there should be limits on the ability to remove federal officials.
Wilcox’s firing in January left the N.L.R.B. in a difficult position, as it only had two members—meaning it couldn’t function properly since three are required for a quorum. Wilcox responded by filing a lawsuit, which could eventually reach the Supreme Court. During a hearing, Judge Howell joked about the case’s potential outcome, recognizing that it might just be a stepping stone toward the Supreme Court.
The outcome of this case could set important precedents regarding executive authority in the U.S. and the independence of federal agencies.
